DI Transfer Waiver Working Group to seek feedback on waiver expansion

Potential change could make student-athletes eligible after first transfer, regardless of sport

Division I student-athletes in all sports could transfer and compete immediately if a concept under consideration by the Transfer Waiver Working Group is adopted by the Division I Council.

“The current system is unsustainable. Working group members believe it’s time to bring our transfer rules more in line with today’s college landscape,” said working group chair Jon Steinbrecher, commissioner of the Mid-American Conference. “This concept provides a uniform approach that is understandable, predictable and objective. Most importantly, it benefits students.”

The working group concept would change waiver criteria to allow approvals for first-time four-year transfers in all sports to compete immediately if they:
•Receive a transfer release from their previous school.
•Leave their previous school academically eligible.
•Maintain their academic progress at the new school.
•Leave under no disciplinary suspension.

The waiver criteria are the same as the legislated exception already allowed for student-athletes who compete in any sport other than baseball, basketball, football or men’s ice hockey.

“More than a third of all college students transfer at least once, and the Division I rule prohibiting immediate competition for students who play five sports hasn’t discouraged them from transferring,” Steinbrecher said. “This dynamic has strained the waiver process, which was designed to handle extenuating and extraordinary circumstances.”

When the Division I Board of Directors placed a moratorium on transfer legislation last fall and asked the Council to appoint the working group, it acknowledged the stress on the waiver process caused by a rule that makes a waiver the only means to immediate competition for some transferring college athletes in Division I.

“We know that challenges will exist with this concept, particularly as it relates to other coaches potentially tampering with currently enrolled student-athletes,” Steinbrecher said. “The working group will continue to examine this, as well as any potential financial aid and academic impacts, so the Council can make a fully informed decision.”

Waiver criteria changes do not follow the regular legislative cycle but still must be approved by the full Division I Council. Steinbrecher also serves as vice chair of the Council.

The group agrees that a waiver process will remain in place for student-athletes who have transferred previously or otherwise do not qualify for the one-time waiver guidelines. Group members think this waiver process should be limited to truly extenuating and unique circumstances that threaten a student-athlete’s health and safety (for example, if the student-athlete is a victim of physical/sexual assault) while recognizing the impact multiple transfers have on the likelihood that a student-athlete graduates.

The working group will seek feedback from Division I members through student-athlete representatives, conference offices, impacted coaches associations and other collegiate athletic professional organizations prior to the Council’s April meeting. The group’s goal is to have the new criteria approved for transfers in the 2020-21 academic year.

This all has to do with the money college football and basketball is bringing in. Why are coaches making phenomenal salaries like $10M/yr when starting NFL football players don't make as much. It's outrageous that people can make so much and the college athlete gets a scholarship and puts their life at risk. The NCAA is profiting from this money coming in for the sports. So, for them, why not make it more interesting so we can bring in more money? It's almost like college athletics is almost going to have to change their amateur status to semi-pro.

I don't particularly like it. What if 10 players from a team transfers? Do they get more initials to make up for the losses? Will the transfers count as an initial at the new school? Much more details will be needed to be worked out for every scenario that may occur.

I am more concerned about the NCAA allowing players likeness to be used in media (example:video games) by giving all student athletes who's likeness or similarity to themselves are used in media the ability to be paid for said likeness.

I know in the past, NCAA football and basketball were the most prolific in terms of video game usage of student athletes. That all came to a halt in 2014. Supposedly later this year the NCAA is going to hold hearings on a way that they would bring that back by coming up with a way to legally pay student athletes (not all sports though). Not sure how that would go, considering scholarship and non scholarship athletes are taken into account.

On the topic at hand though, in a perfect world I'd like to allow the ability to transfer to another school be as close to immediate as possible and allowing to play for their new school as quickly as possible.

This is great news. Jalen Hurts and Joe Burrow are perfect examples of what can happen when any given player is no longer a fit for his old team. Remember, the team has to release the player too, so it's a mutual agreement.

The current transfer portal rules (which came into effect for the 2018-2019 academic calendar) does not require a student-athlete to obtain the school's release consent in order to enter the transfer portal and transfer to another school.

The student-athlete is empowered by the change to the bylaw. Once student-athletes ask that a compliance administrator place their name in the portal, the school has two business days to submit the information.

Previously in Division I, when student-athletes wanted to transfer, they had to ask their coach for permission to contact other schools. If the coach denied the request, student-athletes could make their case to the athletics director.

If permission was still denied, student-athletes could make the request to a designated campus administrator, such as a dean of students. If the request still wasn’t approved, the final step would be to appeal to a committee that consists of professionals on campus and other students.

Those who didn’t receive permission still could transfer but couldn’t be offered athletics aid at the new school.
As such, the proposed immediate eligibility for one-time transfers probably favors the Power Five programs by allowing them to cherry-pick players (who they initially overlooked and did not recruit out of high school) from the Group of Five programs.

I agree with you on that. Everything is made to benefit the P5 schools.

Transfers

The groups also received an update from the Transfer Waiver Working Group. That group, appointed by the board last fall, was charged with studying potential changes to the waiver process. Waiver guidelines can be changed at any time, and that group has recommended that waiver guidelines allow the opportunity for a one-time transfer waiver for student-athletes in the five sports not legislatively allowed to transfer and compete immediately: men’s basketball, women’s basketball, baseball, men’s ice hockey and football. The waiver criteria would mirror the legislative opportunity for student-athletes in other sports. The Division I Council could vote on the guideline changes as early as its May meeting.

The waiver working group also recommended the board lift the moratorium on transfer legislation to allow the membership to consider proposals that could provide permanent access to the one-time transfer opportunity for all Division I student-athletes.

The board agreed to lift the moratorium on transfer legislation for the 2020-21 legislative cycle but recommended to the Council that changes to the waiver process as suggested by the working group are not appropriate at this time. Board members recommended the waiver process be sensitive to student-athlete well-being, especially those impacted by COVID-19 in the interim period.

Tauila Tagavailoa got blessed by the NCAA to play immediately even though playing 5 games as a true frosh. But then maybe they NCAA figures there will probably be no football this fall
